Terms of Service
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and TuneScan GbR ("Company" or "we" or "our"), governing your use of our audio fingerprinting service ("Product" or "Service"). By accessing or using the Product, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Product.
ACCEPTANCE OF TERMS
By using the Product, you affirm that you are of legal age and have the legal capacity to enter into this agreement. You also acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Product on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
DESCRIPTION OF THE PRODUCT
The service consists of three subscriptions tiers: TuneScan Basic, TuneScan Pro and TuneScan Ultimate. Every subscription has the same core functionality. An audio file (.wav, .mp3, etc.) can be taken as an input by our service. The audio fingerprinting technology will be able to determine the tracks and loops that are contained in that file, and will give you all the important stats to easily find the track online. These stats include an ID (ISRC) as well as links to audio streaming services like spotify and youtube music. Despite the astounding quality of the technology, results for a file as well as the accuracy of our technology is not fully guaranteed.
The main difference between the tiers is the amount of file scanning available. A maximum amount of seconds uploaded is defined for every subscription tier. These are 1 hour, 5 hours and 50 hours in ascending order. These limits can be extended by upgrading the subscription. For every tier, one file may be uploaded once every month. One account can only have one subscription tier at a time.
After a subscription cancellation, the service will be usable until the subscription time expires. Subscriptions can be purchased and extended in either monthly or yearly periods.
An user may also try out TuneScan for seven days by using our TuneScan Free Trial option. By choosing this option, you are able to upload up to 15 minutes of audio. After expiration of the trial, you will purchase TuneScan Basic and get another 60 minutes of scanning. The trial as well as any subscription tier can be cancelled at any time.
If an automatic purchase cannot be made, you subscription will be deactivated and you will receive an email with the invoice. After paying the invoice, the subscription will be active again. We will try to charge you up to three times. If all payment intents fail, you subscription will be cancelled. After a successful payment, the billing cycle will not be set to the time the payment has been fulfilled.
USER ACCOUNTS
In order to access certain features of the Product, you may be required to create a user account. When creating your account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
INTELLECTUAL PROPERTY RIGHTS
The Product, including all content and materials provided therein, is protected by intellectual property laws. You acknowledge and agree that all intellectual property rights in the Product belong to the Company or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Product solely for your personal or internal business purposes.
ACCEPTABLE USE
You agree not to use the Product for any unlawful or prohibited purposes. You further agree not to engage in any activity that may disrupt or interfere with the proper functioning of the Product or its associated systems.
DISCLAIMER OF WARRANTIES
The Product is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied. We do not guarantee that the Product will be uninterrupted, error-free, or secure. You acknowledge and agree that your use of the Product is at your own risk.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall the Company be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Product.
TERMINATION
We may, in our sole discretion, suspend or terminate your access to the Product, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
MODIFICATIONS TO THE TERMS
We reserve the right to modify these Terms at any time, in our sole discretion. You are responsible for reviewing these Terms periodically to ensure your continued compliance. By continuing to use the Product after any modifications, you agree to be bound by the revised Terms.
MISCELLANEOUS
These Terms constitute the entire agreement between you and the Company regarding the Product and supersede all prior or contemporaneous agreements. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
